Terms and Conditions for MarylandAutoShare

These Terms and Conditions (“Agreement”) govern the use of the website and services provided by MarylandAutoShare (“Company,” “we,” “us,” or “our”). By accessing or using our website or renting a vehicle from us, you (“Customer,” “you,” or “your”) agree to comply with these Terms and Conditions. Please read them carefully before making a reservation or using our services.
1. Rental Agreement
By booking a vehicle with MarylandAutoShare, you agree to the terms outlined in this Agreement. This Agreement governs the rental of vehicles provided by MarylandAutoShare and includes, but is not limited to, the following conditions:
Eligibility:
You must be at least 21 years of age (or the minimum age required by applicable local law) to rent a vehicle. You must possess a valid driver’s license and a valid payment method in your name.
Driver’s License:
The primary renter must present a valid driver’s license at the time of rental. An international driver’s permit may be required for non-U.S. residents.
Authorized Drivers:
Only drivers listed and approved during the booking process may operate the vehicle. Additional drivers may be added subject to approval and applicable fees.
2. Reservations, Payment, and Cancellations
Reservations:
All reservations must be made through our official booking system. A reservation is not considered confirmed until a confirmation notice is issued.
Payment:
Full payment is required at the time of booking unless otherwise stated. We accept major credit cards, debit cards, or other approved payment methods.
Cancellations and Refunds:
- Cancellations made within 48 hours of the scheduled rental start time may be subject to a cancellation fee.
- Cancellations made after this period may result in no refund.
- Refunds, if applicable, will be issued to the original payment method in accordance with our cancellation policy.
3. Rental Period and Late Returns
Rental Period:
The rental period begins and ends at the times specified in the booking confirmation.
Late Returns:
Vehicles returned later than the agreed return time may incur additional charges. Late fees may be charged at an hourly or daily rate as outlined in the booking details.
Early Returns:
No refunds will be issued for unused rental time if a vehicle is returned early.
4. Vehicle Use
Permitted Use:
The vehicle must be used responsibly and in compliance with all local, state, and federal laws.
Prohibited Use Includes:
- Driving under the influence of alcohol, drugs, or controlled substances
- Off-road driving or use on unapproved terrain
- Subleasing or allowing unauthorized drivers
- Using the vehicle for illegal purposes or racing
- Violating traffic or safety laws
Mileage:
Mileage limits, if applicable, are specified during booking. Additional charges may apply for exceeding the allowed mileage.
Fuel:
Vehicles must be returned with the same fuel level as provided at pickup. Failure to do so may result in fuel and service charges.
5. Insurance and Liability
Insurance Coverage:
Insurance options may be available at the time of booking. Customers are responsible for understanding their selected coverage.
Damage or Loss:
You are responsible for any damage, theft, or loss of the vehicle during the rental period. All incidents must be reported immediately.
Liability:
Important: The renter assumes full responsibility for damages to the vehicle, third-party property, or injuries resulting from negligence, misuse, or violation of this Agreement.
Third-Party Coverage:
Personal auto insurance or credit card benefits may provide rental coverage. It is your responsibility to verify such coverage.
6. Vehicle Return
Return Location:
Vehicles must be returned to the location specified in the booking confirmation unless prior arrangements are approved.
Condition:
The vehicle must be returned in the same condition as received, excluding normal wear and tear. Excessive dirt, odors, or damage may result in cleaning or repair fees.
Inspection:
Vehicles are subject to inspection upon return. Any damages or issues identified may result in additional charges.
7. Privacy and Data Usage
We collect and process personal information in accordance with our Privacy Policy. By agreeing to these Terms and Conditions, you acknowledge and consent to our data practices.
8. Indemnification
You agree to indemnify, defend, and hold harmless MarylandAutoShare, its owners, affiliates, employees, and agents from any claims, damages, liabilities, costs, or expenses (including legal fees) arising from:
- Your use of the vehicle
- Any breach of this Agreement
- Any violation of applicable laws
- Damage or injury caused during the rental period
9. Governing Law and Dispute Resolution
Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of the State of Maryland.
Dispute Resolution:
Any disputes arising from this Agreement shall be resolved through binding arbitration in Maryland, unless prohibited by law. If arbitration is unenforceable, disputes shall be resolved in a court of competent jurisdiction within Maryland.
10. Limitation of Liability
To the fullest extent permitted by law, MarylandAutoShare shall not be liable for:
- Indirect, incidental, or consequential damages
- Loss of profits or loss of use
- Third-party claims arising from vehicle use
11. Modifications and Updates
MarylandAutoShare reserves the right to modify or update these Terms and Conditions at any time. Updates will be posted on our website with a revised effective date. Continued use of our services constitutes acceptance of the updated terms.
